CIRCLING THE WAGONS IN ILLINOIS - JUST A MINUTE -Radio for Friday 110708

Once more we’re needing to set the record straight.

 

When Ms. Kagen was announced as the appointee to the high court, of course everyone had to search her records etc. etc. – but Ms Kagen was not particularly enthralled with having every comma examined – I know I wouldn’t be. Especially since she did not know that every word was going to be parsed and turned over and over.  And you think back and somebody turned the lights down low in Illinois. A not infrequent occasion.

 

So after the meetings with the Senators on the Judiciary Committee and doing a lot of careful hair splitting, of course she was appointed.

 

But there’s the problem of her having been Solicitor General – the person who argues the U.S. case before the court. And I suppose a lot of communication that goes on between the Justices themselves and their clerks and looking up precedents etc. etc.

 

I’m not expert in the law and certainly not at that level – but you have nine men and women who are!... and that’s what takes a lot of time. Eventually Justice Kagan’s opinions concerning some of the cases she had argued before the Court came to light … legal lights… and I suppose some saw some wiggle room there… that is making a decision along some line initially that was not *exactly* followed subsequently.  Those back and forth proceedings only show up when there is a divided opinion… and even then each Justice is allowed to agree or dissent. And when you get to gun ownership – which is what this case is all about – well things become even more touchy.

 

So the National Rifle Association – which is the largest gun owners association in the USA I’m pretty sure – has a new President – a man I happened to know from my service in the Senate – his name is David Keene.  And he’s been associated with conservative causes back to my day… which is reaching back there. Knowing him to be a writer and conservative person – I was a bit surprised when I saw he was now in this post – and apparently he’s been working to see what can be done about this hurdle of gun registration and ownership – and Illinois is not an easy state to tackle.  Big city – yes.  Lots of hunters and other gun owners… You Betcha!  So – this hammering out an agreement is going to be fun to watch.  The NRA publication says they’ve counted a reversal of the Illinois Atty. General a BIG victory – and have given the AG an implied hurdle… that come the 29th of July, they are expecting to see the wheels of progress grind – and they expect it to grind in the direction of gun ownership. I think it’s going to be an interesting month on that score.  The Court takes its summer recess. So I don’t think we’ll hear much about this until Fall begins… then we’ll see how much explaining will need to be done on the advisability of changing the procedure of gun ownership in Illinois.

 

My guess is it’s going to be something gun owners will hear a lot about… and both the GOP and the Dems have lots of hunters/fishers in their corners. So it’s not going to be an easy road.

            Just a Minute: Your attention has been focused on Orlando – but there are more important fish to fry such as discrepancies which seem to occur between the e-mails Solicitor General Elanor Kagan provided about “Obama care” – and the sworn statement she later gave when being examined for the High Court.

          Now, attention is being focused on the struggle between the Illinois Democrat Governor Pat Quinn, who is being asked by a letter signed by 49 House members requesting his committee to investigate discrepancies that don’t match the sworn testimony given concerning ‘Obama care’ before Ms. Kagan’s appointment.

          The NRA has a new president, David Keene -- anxious to have the entire record carefully examined. Chicago has resisted Illinois law exposing all gun owners in the Windy City to have their names published and thus become targets for gangsters and thieves. So public attention is now directed to what Mrs. Elanor Kagan wrote as Solicitor General, before she was sworn in as Associate Justice. State Senate passed the Illinois law, 42-1, overturning a ruling by the Illinois Attorney General.    <> I’m Jack Buttram.
